Description of proposal:  Application in terms of Section 15(2)(o) and Section 15(2)(b)  of the Municipal Land Use Planning By-law for Beaufort West Municipality. This application is for consideration of a consent use and permanent departure for the relaxation of the hight restriction with 9 meter on erf 28, situated at Stanbridge Street, Beaufort West, in order to erect a freestanding base telecommunication station.

Notice is hereby given in terms of Section 45 of the By-law on Municipal Land Use Planning for Beaufort West Municipality that the above-mentioned application has been received and is available for inspection during weekdays between 07:30 and 16:15 at the Office of the Director: Corporate Services, 112 Donkin Street, Beaufort West. Any written comments may be addressed in terms of Section 50 of the said By-law to the Municipal Manager, Beaufort West Municipality, Private Bag 582, Beaufort West, 6970, Fax No. 023-415 1373, e-mail: admin@beaufortwestmun.co.za on or before 16:00 on Monday, 12 August 2019, quoting your, name, address or contact details, interest in the application and reasons for comments. Telephonic enquiries can be made to the Senior Manager: Corporate Services, Mr. P. Strümpher at Tel. No. 023-414 8103. The Municipality may refuse to accept comment received after the closing date. Any person who cannot write will be assisted by a Municipal official at the abovementioned office by transcribing their comments.

Notice No. 137/2019: APPLICATION FOR CONSENT USE AND PERMANENT DEPARTURE: ERF 28, STANBRIDGE STREET

Notice is hereby given in terms of Section 61 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 21/2019 that the Authorized Official has in terms of Section 60 approved  in whole the application for the consent use and permanent departure for the relaxation of the high on Erf 28, Beaufort West in terms of Section 60 of the By-law on Municipal Land Use Planning for Beaufort West Municipality as follows:-

That the following application applicable to erf 28, Beaufort West: -

  1. That approval is granted to a Consent Use and a Permanent Departure of the relaxation of the height restriction with 9 meter on Erf 28, Stanbridge Street located in Beaufort West Municipal Area as per Site Plan CRDS 1605 REV 01: Sheet No. 04 of 06.
  2. That the approval shall only cover the consent use and the permanent departure and shall not be construed as to depart from any other Council requirement of legal provision.
  3. That the above approval shall be valid for a period of five (5) years.
  4. That the Consent Use and the Departure is permanent and so shall it remain.
  5. That this approval does not imply or give exemption from any other permission or approval, which may be required by any other law or authority.

The reasons for the abovementioned decision are as follows:-

  1. No objections were received during the public participation process.
  2. Provided that mitigating measures are complied with, the impact on the natural environment will be very low.
  3. The impact on the agricultural resources of the subject property is low.

Any person whose rights are affected by the above decision and or conditions may appeal to the Appeal Authority by submitting a written appeal to the Municipal Manager, Beaufort West Municipality, Private Bag 582, 112 Donkin Street, Beaufort West, 6970, so to reach the undersigned within 21 days from the date of publication of this notice.
