Notice No. 101/2018: APPLICATION FOR PARTIAL REZONING OF ERF 202, HOSPITAL STREET: NELSPOORT

Notice is hereby given in terms of Section 61 of the Municipal Land Use Planning By-law Planning for Beaufort West Municipality, Notice No. 72/2015 that the rezoning of a portion of Erf 202 from Undetermined to Institutional Zone II in terms of Section 15.2 (a) of Beaufort West Municipal Land Use Planning By-law, 2015, is hereby approved in terms of Section 60 of the Beaufort- West Municipality: Land Use Planning By-law, 2015, subject to the following conditions imposed in terms of Section 66 of the said By-law:

  1. That approval of the application will expire in terms of the Municipal Land Use Planning By-law for Beaufort West, 2015, if the approval is not exercised within 5 years from the date of this approval.
  2. That the applicant must bear the cost of the measuring equipment and distribution board for electricity and water and must provide a certificate of compliance for the electrical installation before the power supply will be switched on.

The reasons for the decision are as follows:

  1. The partial rezoning of Erf 202 from Undetermined to Institutional Zone II is considered desirable as it facilitates the more effective utilization of existing resources.
  2. An Institutional Zone II zoning is considered compatible with the surrounding community-oriented land uses.
  3. The proposal does not have any negative consequences for the surrounding landowners.

Notice is hereby given in terms of Section 61 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 72/2015 that the Authorized Official has in terms of Section 60 approved  in whole the application for the permanent relaxation of the Western side building line on erf 2080 to 0 m in terms of Section 60 of the By-law on Municipal Land Use Planning for Beaufort West Municipality as follows:-

That the application applicable to Erf 2080, Beaufort West for the permanent relaxation of the Western side building line, is hereby approved in terms of Section 60 of Beaufort West Municipality: Land Use Planning By-law, 2015, subject to the following conditions imposed under Section 66 of the aforesaid by-law:-

1.  That the Western side building line is relaxed to 0 meters subject thereto that no doors or windows are allowed in the wall fronting to the relevant side boundary.

The reasons for the abovementioned decision are as follows:-

  1. No restrictive provisions regarding a side building line are contained in Deed of Transfer T5922/2004.

Notice is hereby given in terms of Section 61 of the Municipal Land Use Planning By-law Planning for Beaufort West Municipality, Notice No. 72/2015 that the Authorized Officer has approved the application for a temporary land use departure for guest rooms on erf 1226, Beaufort West in terms of Section 60 of the above-mentioned by-law.

That the application for a temporary land use departure on erf 1226, 94 Bird Street, Beaufort West, be approved in terms of Section 60 of the Beaufort West Municipality: Land Use Planning By-law, 2015, subject to the following conditions imposed in terms of Section 66 of the aforesaid by-law:-

  1. The temporary departure will be valid for a period of five years.
  2. There must be two parking spaces for the owners (it may include a garage) as well as one parking space per room rented.
  3. Parking must be accessible and not in tandem format.

Notice is hereby given in terms of Section 61 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 72/2015 that the Authorized Official has approved in whole the application for the permanent relaxation of the street building line and southern side building line on erf 9062 respectively to o m and 1 m in terms of Section 60 of the By-law on Municipal Land Use Planning for Beaufort West Municipality as follows:-

That the application applicable to Erf 9062, Beaufort West, is hereby approved in terms of Section 60 of Beaufort West Municipality: Land Use Planning By-law, 2015, subject to the following conditions imposed under Section 66 of the aforesaid by-law:-

1. That the existing extensions are being erected from zero meters instead of four meters from the street building line and one meter instead of two meters from the southern side building line.

 

The reasons for the abovementioned decision are as follows:-

1. No restrictive provisions regarding a side building line are contained in Deed of Transfer T27127/2018.

2. The Municipality's rights to apply building lines on the property will not adversely affect the environment as the regulation of building lines is adequately addressed in the Scheme Regulations.

3. The relaxation of the side building line will enable the owner to improve his property for personal use and increase its resale value.
