Notice No. 96/2020: APPLICATION FOR PERMANENT DEPARTURE: COVERAGE AND BUILDING LINES: ERF 3342, 26 BARNARD STREET: BEAUFORT WEST

Notice is hereby given in terms of Section 61 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 21/2019 that the Authorized Official has in terms of Section 60 rejected the application for the permanent departure of the coverage and building lines on erf 3342, BeaufortWest in terms of Section 60 of the By-law on Municipal Land Use Planning for Beaufort West Municipality as follows:-

1.      That the following applications applicable to Erf 3342, Beaufort West: -

Permanent Departure in terms of Section 15.(2)(b) for the following: -

  1. North-eastern rear building line:     zero meters instead of one meter;
  2. North-western side building line:   zero meters instead of one meter;
  3. South-eastern side building line:  zero meters instead of one meter; and
  4. Exceeding coverage by 18% (68% instead of 50%), be

REJECTED in terms of Section 60 of the Municipal Land Use Planning By-Law for Beaufort West Municipality, Notice No. 21/2019.

2.        The reasons for my decision are as follows: -

2.1     The proposed structures on the 0 meter North East rear building line have a negative visual and aesthetic impact on the adjacent Erf 3333.

2.2     The proposed position and the location of the proposed structures will result in a lack of sunlight and natural ventilation on both the application property and Erf 3333.

2.3    The size of the outbuildings is disproportionate to the dwelling.

2.4     The proposed coverage is not in line with the prevailing coverage in the surrounding areas.

Any person whose rights are affected by the above decision and or conditions may appeal to the Appeal Authority by submitting a written appeal to the Municipal Manager, Beaufort West Municipality, Private Bag 582, 112 Donkin Street, Beaufort West, 6970, so to reach the undersigned within 21 days from the date of publication of this notice. (ii) Section 15(2)(0) of the Beaufort West Municipality ByLaw on Municipal Land Use Planning, 2019 for a consent use to permit a cemetery on the Open Space Zone II erf. 
 

 

(iii) Section 15(2)(d) of the Beaufort West Municipality ByLaw on Municipal Land Use Planning, 2019 for the subdivision of the Remainder of Farm 185 in order to give effect to the subdivisional zoning to be considered as part of this application.
  The aforementioned process are required to formalize the existing Sewerage works, existing Cemetery and to extend the cemetery.
   

Notice is hereby given in terms of Section 45 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, that the above-mentioned application has been received and is available for inspection during weekdays between 07:30 and 16:15 at the Office of the Director: Corporate Services, 112 Donkin Street, Beaufort West. Notice No.104/2020: APPLICATION FOR TEMPORARY LAND USE DEPARTURE: PORTION 24 OF FARM 162, SOUTH LEMOENFONTEIN: BEAUFORT WEST

Notice is hereby given in terms of Section 61 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 21/2019 that the Authorized Official has in terms of Section 60 refused the application for the temporary departure on Portion 24 of Farm 162, South Lemoenfontein, Beaufort West in terms of Section 60 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, 2019 as follows:-

1. That the following application applicable on Portion 24 of Farm 162, South Lemoenfontein, Beaufort West:-

(1)  That the application for a temporary departure in terms of Section 15(2)(c) of the Municipal Land Use Planning By-Law, Beaufort West Municipality, 2019 to allow the storing, recycling and preprocessing of tyres;

BE REFUSED, in terms of Section 60 of the Municipal Land Use Planning By-Law, Beaufort West

Municipality, 2019 

2.        The reasons for the abovementioned decision are as follows:-

  1. The proposed land use is an industrial land use that is not compatible with the surrounding agricultural land uses or the uses or the related consent use permitted on land zoned for agricultural purposes.
  2. The proposal will have a negative impact on the rural character of the area and the utilisation of the surrounding properties, in accordance with the recommendations of the Western Cape Land Use Planning Guidelines for Rural Areas, 2019. 
  3. The proposal is not in keeping with the recommendations of the Western Cape Land Use Planning Guidelines for Rural Areas, 2019 and there is no justification to deviate from the said guideline.

Any person whose rights are affected by the above decision and or conditions may appeal to the Appeal Authority by submitting a written appeal to the Municipal Manager, Beaufort West Municipality, Private Bag 582, 112 Donkin Street, Beaufort West, 6970, so to reach the undersigned within 21 days from the date of publication of this notice.
