Description of proposal:  Application in terms of Section 15(2)(b) of the Municipal Land Use Planning By-law for Beaufort West Municipality. Notice is hereby given in terms of Section 45 of the By-law on Municipal Land Use Planning for Beaufort West Municipality that the above-mentioned application has been received and is available for inspection during weekdays between 07:30 and 16:15 at the Office of the Director: Corporate Services, 112 Donkin Street, Beaufort West. Any written comments may be addressed in terms of Section 50 of the said By-law to the Municipal Manager, Beaufort West Municipality, Private Bag 582, Beaufort West, 6970, Fax No. 023-415 1373, e-mail: admin@beaufortwestmun.co.za on or before 16:00 on Monday, 8 October 2018, quoting your, name, address or contact details, interest in the application and reasons for comments. Notice No. 90/2018: APPLICATION FOR CONSENT USE: ERF 2117: 115 DONKIN STREET: BEAUFORT WEST

Notice is hereby given in terms of Section 45 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 72/2015, that the Authorized Official has in terms of Section 60 approved the above application in whole through the following decision:-

1.  That the application for a consent use on erf 2117, 115 Donkin Street, Beaufort West, be approved in terms of Section 60 of the Beaufort West Municipality: Land Use Planning By-law, 2015, subject to the following conditions imposed in terms of Section 66 of the said By-Law.

Reason for the decision is as follows:

  1. The objections submitted by the objector are not considered relevant to the application and cannot be considered in the assessment of a liquor store that contributes to the shopping centre and residents of Beaufort West.
  2. It will not adversely affect the environment because there are already two (2) liquor stores within a 100 meter radius.
  3. That there are no objections from Setplan to not proceed with the approval of the application.

Notice No. 932018: APPLICATION FOR TEMPORARY LAND USE DEPARTURE ERF 628, 1 LOOP STREET: MERWEVILLE

Notice is hereby given in terms of Section 45 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 72/2015 that the Authorized Official has in terms of Section 60 approved  in whole the application for the temporary land use departure on erf 628, Merweville as follows:-

1.  That the application for a temporary land use departure on erf 628, 1 Loop Street, Merweville, be approved in terms of Section 60 of the Beaufort West Municipality: Land Use Planning By-law, 2015, subject to the following conditions imposed under Section 66 of the said By-law –

  1. That trade may be carried out with non-perishable and perishable products, provided that only perishable products may be traded if the applicant has suitable and acceptable refrigeration facilities to the satisfaction of the Director: Community Services and person applying for the departure must indicate what he/she intends to trade with and whether perishable products can be kept by the health departments.
  2. If a dealer's refrigeration facilities do not meet the requirements, such a person will be acted upon in terms of Regulation R185 of 30 January 1987 and that such person's departure will immediately be cancelled by the Health Inspector concerned.
  3. Industries are excluded.
  4. If trade is conducted from the dwelling, only one room may be used for business activities and, may such room not be used for residential purposes.
  5. If the business is operated from a temporary structure, no restrictions on building lines will be applied.

Reasons for the decision are as follows:

  1. The objections submitted by an objector are not considered relevant for the application and may not be considered in the evaluation of a home shop that contributes to the residents of Merweville.
  2. That the City and Regional Planner has no objections not to proceed with the approval of the application.
  3. The operation of a home store will not adversely affect the environment.

Any person whose rights are affected by the above decision and or conditions may appeal to the Appeal Authority by submitting a written appeal to the Municipal Manager, Beaufort West Municipality, Private Bag 582, 112 Donkin Street, Beaufort West, 6970, so to reach the undersigned within 21 days from the date of publication of this notice.
