Description of proposal:  The matter for consideration is an application for the partial rezoning of erf 1341 from Residential Zone I to Business Zone IV and removal of a restrictive title conditions in terms of Sections 15(2)(a) and (f) of the Municipal Land Use Planning By-law for Beaufort West in order to establish a warehouse.

Notice is hereby given in terms of Section 45 of the By-law on Municipal Land Use Planning for Beaufort West Municipality and Regulation 4.7.1 of the Scheme Regulations applicable to Beaufort West, that the above-mentioned application has been received and is available for inspection during weekdays between 07:30 and 16:15 at the Office of the Director: Corporate Services, 112 Donkin Street, Beaufort West. Any written comments may be addressed in terms of Section 50 of the said By-law to the Municipal Manager, Beaufort West Municipality, Private Bag 582, Beaufort West, 6970, Fax No. 023415 1373, e-mail: admin@beaufortwestmun.co.za on or before 16:00 on Monday, 7 October September 2019, quoting your, name, address or contact details, interest in the application and reasons for comments. Telephonic enquiries can be made to the Senior Manager: Corporate Services, Mr. P. Strümpher at Tel. No. 023-414 8103. The Municipality may refuse to accept comment received after the closing date. Notice No. 03/2020: PROPOSED PARTIAL REZONING OF ERF 1341 AND REMOVAL OF RESTRICTIVE CONDITION OF TITLE OF ERF 1341, 41 VOORTREKKER STREET: BEAUFORT WEST

Notice is hereby given in terms of Sections 61 of the By-law on Municipal Land Use Planning for Notice is hereby given in terms of Section 61 of the Municipal Land Use Planning By-Law for Beaufort West Municipality, Notice No. 21/2019, that in terms of Section 60, the Authorized Officer has rejected the application for the Removal of Restrictive Title Conditions and Partial Rezoning of Erf 1341, 41 Voortrekker Street, Beaufort West.

1.           That the following application applicable to Erf 1341, 41 Voortrekker Street, Beaufort West: -

  1. Rezoning in terms of Section 15.2(a) of the Municipal Land Use Planning By-Law for Beaufort West, 2019 from Residential Zone I to Business Zone IV to establish storage facilities on a portion of the property; and
  2. Removal of Restrictive Title Condition 11.B.1 & 2 in Title Deed T9198/1996, in terms of Section 15.2(f) of the Beaufort West Municipal Land Use Planning By-law, 2019, in order to establish structures within the southern portion of the to set up property.

REJECTED in terms of Section 60 of the Beaufort West Municipal Land Use Planning By-law, 2019.

2.        The reasons for the decision are as follows:

  1. The proposed storage facility is of an industrial nature and is not compatible with a residential area.
  2. The proposed land use will adversely affect the existing residential character of the residential area.

Any person whose rights are affected by the above decision and or conditions may appeal to the Appeal Authority by submitting a written appeal to the Municipal Manager, Beaufort West Municipality, Private Bag 582, 112 Donkin Street, Beaufort West, 6970, so to reach the undersigned within 21 days from the date of publication of this notice.
