Notice is hereby given in terms of Section 61 of the By-law on Municipal Land Use Planning for Beaufort West Municipality, Notice No. 21/2019 that the Authorized Official has in terms of Section 60 approved  in whole the application for the temporary departure of Portion 1 on Farm 168, Steenrotsfontein, Beaufort West in terms of Section 60 of the By-law on Municipal Land Use Planning for Beaufort West Municipality as follows:-

That the following application applicable to Portion 1 on Farm 168, Steenrotsfontein, Beaufort West: -

  1. That approval is granted in terms of Section 15(2)(c) of the Municipal Land Use Planning By-Law, Beaufort West for a temporary departure of the Farm 168/1, Steenrotsfontein, Beaufort West.
  2. That the approval shall be taken to cover only the departure applied for and shall not be construed as to depart from any other Council requirement of legal provision.
  3. That the above approval shall be valid for a period of five (5) years from date of final approval.
  4. That the temporary departure will be allowed for a period of five (5) years from the date of implementation which date must be within the five (5) years of approval refer to point 3 above.
  5. That the mined area be suitably rehabilitated in accordance with the environmental management plan approved by the National Department of Mineral Resources once mining activities ceases and / or the approval period of the mine lapses, whichever occurs first.
  6. That this approval does not imply or given exemption from any other permission or approval, which may be required by any other law or authority.

The reasons for the abovementioned decision are as follows:-

  1. No objections were received during the public participation process.
  2. Provided that mitigating measures are complied with, the impact on the natural environmental will be very low.
  3. The impact on the agricultural resources of the said property is low.
  4. The proposed land use is considered desirable as the maintenance of the existing road network and the construction of new roads are essential for the functioning of rural towns and it is more cost effective to source the construction material in close proximity of the project.

Any person whose rights are affected by the above decision and or conditions may appeal to the Appeal Authority by submitting a written appeal to the Municipal Manager, Beaufort West Municipality, Private Bag 582, 112 Donkin Street, Beaufort West, 6970, so to reach the undersigned within 21 days from the date of publication of this notice. That the following applications applicable to Erf 3458, Beaufort West:

  1. Removal of restrictive title condition C.4(d), as set out in Title Deed T4425 / 19885, in terms of Section 15.2(f) of the Beaufort West Municipal Land Use Planning By-Law, 2019 in order to establish a freestanding base communications station allow within 8 meters of street building line restriction on the property; and

The reasons for the decision are as follows:

  1. The proposed telecommunications structure is not compatible with the residential land uses currently taking place on the property.
  2. The proposed 36 meter high latice mast will have a negative impact on the visual and aesthetic quality of the residential area.
  3. No man-made structure or natural elements exist that can mitigate or mitigate the visual impact.
  4. The property does not have any unique or exceptional features that require the approval of the cellphone masts at that particular location.
